Terms of Service
The rules for accessing and using Pricemark’s website, software, AI quote generation, exports, and related services.
Agreement
These Terms of Service govern access to and use of Pricemark. By creating an account, starting a trial, accepting an order, or using the service on behalf of a company, you confirm that you are authorized to bind that company to these terms.
Pricemark is currently operated by its founder. Formal company details will be added when available.
Business use only
Pricemark is intended for business and professional use only. It is not intended for consumers or personal household use.
Early access and beta status
Pricemark is currently provided as an early-access or beta product. The service may change, be interrupted, contain errors, or be discontinued at any time.
The service
Pricemark is a cloud software service for creating and managing AI-assisted construction quotes. The service may include upload workflows, quote parsing, line-item generation, calculation support, templates, exports, analytics, integrations, and related documentation.
Customer content and responsibility
Customers retain ownership of the project descriptions, quote documents, price lists, catalogs, images, data, and other materials they submit to Pricemark. Customers grant Pricemark the rights needed to host, process, display, transform, and transmit that content to provide the service.
Customers are responsible for the accuracy, legality, and suitability of all customer content and all quotes created with Pricemark. Pricemark output must be reviewed before it is used with clients or relied on for pricing, scope, taxes, compliance, or contractual commitments.
AI output and professional review
AI-generated quotes, prices, measurements, assumptions, taxes, margins, materials, and scope descriptions are drafts only. Customers are solely responsible for reviewing and approving all outputs before using them with clients or relying on them commercially.
Pricemark does not provide engineering, legal, tax, accounting, architectural, construction compliance, or other professional advice.
Accounts and users
- Customers are responsible for account security and for activity by their authorized users.
- Customers must keep billing, account, and security information accurate.
- Customers may not share credentials, bypass access controls, or allow unauthorized users to access the service.
Acceptable use
- Do not use Pricemark unlawfully, deceptively, or in a way that infringes third-party rights.
- Do not reverse engineer, copy, resell, or use the service to build a competing product except where law expressly allows it.
- Do not interfere with the service, test security without authorization, submit malware, overload infrastructure, or bypass usage limits.
- Do not upload content you do not have the right to use or process.
- Do not use Pricemark for safety-critical decisions, employment decisions, credit or lending decisions, insurance eligibility, medical or legal advice, public authority decisions, or any use classified as prohibited or high-risk unless separately agreed in writing.
Subscriptions, fees, and taxes
Pricemark does not currently take payments through this website. Paid plans, fees, renewals, refunds, usage limits, or taxes apply only if they are separately agreed in writing, shown in an order, or made available through a future checkout flow.
Third-party services
Pricemark may connect to third-party services such as storage, email, payments, analytics, AI providers, or customer-selected integrations. Third-party services are governed by their own terms and privacy policies. Pricemark is not responsible for third-party services outside our control.
Intellectual property
Pricemark and its software, design, models, workflows, templates, documentation, and brand assets are owned by Pricemark or its licensors. Except for the access rights expressly granted to customers, no rights are transferred.
Suspension and termination
We may suspend or limit access if use of the service creates security, legal, payment, or operational risk. Customers may stop using the service or cancel according to their plan or order. Termination does not remove payment obligations already incurred.
Customer indemnity
Customer will defend and indemnify Pricemark against claims, losses, damages, liabilities, costs, and expenses arising from customer content, customer’s use of generated quotes, customer’s violation of law, customer’s breach of these terms, or customer’s use of Pricemark with its own clients.
Disclaimers and limits
Pricemark is provided on an as-is and as-available basis to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, secure, error-free, accurate, complete, compliant, profitable, or accepted by any client.
No service-level agreement, uptime commitment, support response time, or availability warranty applies unless separately agreed in writing.
To the maximum extent permitted by law, Pricemark is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, replacement services, goodwill, business opportunities, or claims from the customer’s own clients.
To the maximum extent permitted by law, Pricemark’s total liability for all claims is limited to the greater of €100 or the amount paid to Pricemark by the customer in the 12 months before the claim.
Nothing in these terms limits liability that cannot legally be limited, such as fraud, willful misconduct, personal injury, or mandatory rights that cannot be excluded by law.
Governing law
These terms are governed by the laws of Belgium, excluding conflict-of-law rules, unless mandatory law provides otherwise.
Changes
We may update these terms as the service changes. Material changes will be communicated through the website, product, email, or another reasonable method.
